How Do Courts Decide Alimony and Maintenance in India? One of the most common questions people ask during a divorce or matrimonial dispute is: How is alimony calculated in India? The answer is not as straightforward as many people think. Unlike some countries, India does not have a fixed formula for calculating monthly maintenance or alimony. Every case is decided on its own facts and circumstances.

When determining maintenance, courts examine several factors before arriving at a fair amount. One of the most important considerations is the husband's income and earning capacity.
