Case overview
Case Name: Raj Kumari & Ors. vs. Vijay Pal & Ors.

In a significant judgment delivered by Hon’ble Mrs. Justice Sudeepti Sharma, the Punjab & Haryana High Court in FAO-1032-2017 granted substantial relief to the claimants by enhancing compensation in a motor accident case. Mr. Naresh Jain, Advocate from Jain Legal Chambers, appearing for the appellants, successfully highlighted key errors in the Tribunal’s assessment and effectively advanced the case on behalf of the claimants.

The Court enhanced the compensation from ₹29.98 lakh to ₹67.39 lakh along with 9% interest, after correcting the income calculation, disallowing excessive tax deductions, and granting future prospects. Importantly, it was held that married daughters are entitled to compensation as dependents, reflecting a progressive interpretation of the law—an aspect strongly urged by Mr. Naresh Jain, Advocate from Jain Legal Chambers.

This judgment reinforces the principle of just compensation and ensures equitable relief .
